Pursuant to Article 73 of the Constitution of the Republic of Turkey, everyone is obliged to pay taxes according to their financial capacity. For this reason, a tax debt is not only a financial but also a constitutional responsibility.<\/span><\/p><p><span style=\"font-weight: 400;\">However, tax debts can occasionally be assessed incorrectly, become time-barred, or collection proceedings may be initiated again for debts that have already been paid. In such cases, taxpayers have the right to object and file a lawsuit. We have detailed the tax debt objection process and the points to consider according to the current legislation for 2025.<\/span><\/p><h2><b>What is a tax debt?<\/b><\/h2><p><span style=\"font-weight: 400;\">Tax debt arises as a result of the tax that the taxpayer is obliged to pay accruing and becoming definitive. For a tax to come into existence, all of the following processes must be completed:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Occurrence of the taxable event (earning income, delivery of goods, etc.)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Submission of the tax return<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assessment of tax (calculation by the tax authority)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Service of the notification<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">If the debt is not settled within the payment period, late payment interest and penalties will apply.<\/span><\/p><p><span style=\"font-weight: 400;\">Example: A self-employed taxpayer is obliged to declare their 2024 income tax in March 2025. When the payment period is exceeded, the tax debt becomes final and late-payment interest begins to accrue.<\/span><\/p><h2><b>How to Appeal Against a Tax Debt?<\/b><\/h2><p><span style=\"font-weight: 400;\">The primary way to challenge a tax debt is to object to the payment order. When a payment order is issued to collect the debt, it is possible for the taxpayer to exercise their legal rights against this procedure.<\/span><\/p><h3><b>Tax Debt Appeal Period (2025)<\/b><\/h3><p><a href=\"https:\/\/www.lexpera.com.tr\/resmi-gazete\/metin\/amme-alacaklarinin-tahsil-usulu-hakkinda-kanun-8469-6183\/1\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Law No. 6183 on the Procedure for the Collection of Public Receivables<\/span><\/a><span style=\"font-weight: 400;\">\u2019according to Article 58 of the, against the payment order <\/span><b>within 15 days of the date of service<\/b><span style=\"font-weight: 400;\"> An objection must be raised. This time limit is a forfeiture period.<\/span><\/p><p><span style=\"font-weight: 400;\">Important Note: If the deadline is missed, the debt shall become final and subject to enforcement proceedings.<\/span><\/p><h3><b>Grounds for Appeal<\/b><\/h3><p><span style=\"font-weight: 400;\">The taxpayer may object to the payment order on the following grounds:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The non-existence of such a debt,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The partial payment of the debt,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Statute-barring of a debt.<\/span><\/li><\/ul><h2><b>The Effect of Objecting to a Tax Debt and Stay of Execution<\/b><\/h2><p><span style=\"font-weight: 400;\">Merely submitting a petition of appeal does not halt the tax office's enforcement proceedings.
