Recent amendments to the Animal Protection Law No. 5199 and the Turkish Penal Code provide for various responsibilities and sanctions for all living creatures, from stray animals to those with owners. This article examines the duties of municipalities, the legal rights of individuals, and the penal regulations targeting those who harm animals.<\/p><h2>Law No. 5199 and 2025 Updates<\/h2><p>The purpose of the Animal Protection Law is to guarantee that animals lead their lives in a healthy environment. Important amendments were made in 2021, and these provisions were clarified through implementation-focused regulations during the 2024-2025 period.<\/p><ul><li aria-level=\"1\">Animal torture, killing, and mistreatment are no longer considered misdemeanours but are treated as offences.<\/li><li aria-level=\"1\">Imprisonment is provided for instead of a judicial fine.<\/li><li aria-level=\"1\">Mandatory duties have been assigned to municipalities regarding the protection of stray animals.<\/li><\/ul><h2>Legal Obligations of Municipalities<\/h2><p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5199&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">Law No. 5199<\/a>\u2019Pursuant to Articles 4 and 6 of the same, municipalities have the following obligations regarding animal rights:<\/p><ul><li aria-level=\"1\">To collect stray animals, have them treated, neutered, marked and returned to their natural habitat.<\/li><li aria-level=\"1\">To establish and operate animal shelters.<\/li><li aria-level=\"1\">Meeting the food, water and shelter needs of animals.<\/li><li aria-level=\"1\">To strictly avoid practices such as exiling stray animals to rural areas or killing them.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-db181d0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"db181d0\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-inner-column administration.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-665e243 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"665e243\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 sterilisation budget effectively,<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is observed that animals are being exiled out of the city.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">These situations may be the subject of an annulment action on the grounds that the administration has acted unlawfully, and may also be subject to criminal prosecution against the relevant public officials.<\/span><\/p><h2><span style=\"font-weight: 400;\">Criminal Consequences of Harming an Animal<\/span><\/h2><p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Turkish Penal Code<\/span><\/a><span style=\"font-weight: 400;\">\u2019With the new provisions added to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Regarding the person who harms animals <\/span><b>Imprisonment from 3 months to 2 years<\/b><span style=\"font-weight: 400;\"> a penalty is stipulated.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the death of the animal is caused, this penalty may be applied more severely.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the offence is committed by a public official, an increase in the sentence is applicable.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Abandoning a pet on the street is also punished with a Visits are possible with the permission of the Governor's Office or by notifying the municipality.<\/span><\/p><h4><span style=\"font-weight: 400;\">Is a person who starves an owned animal punished?<\/span><\/h4><p><span style=\"font-weight: 400;\">Yes.
