From the moment the status of suspect or defendant is acquired, the person is faced not only with an allegation, but also with the state's power to punish. Therefore, it is of great importance that rights are fully protected during the stages of accusation, detention and taking statements, and that the process is conducted in accordance with the procedure.<\/span><\/p><p><span style=\"font-weight: 400;\">As Azel Law and Consultancy, in this article, within the framework of current provisions of the Code of Criminal Procedure (CMK) and the Turkish Penal Code (TCK), we explain the fundamental rights that individuals possess during the criminal investigation process by shedding light on issues frequently encountered in practice.<\/span><\/p><h2><b>Legal Information Regarding the Process of Accusation, Detention and Statement-Taking<\/b><\/h2><h3><b>Accusation Stage: When Does the Status of Suspect Begin?<\/b><\/h3><p><span style=\"font-weight: 400;\">When there is reasonable suspicion that an act attributed to a person constitutes an offence, that person acquires the status of a \u201csuspect\u201d. At this stage, pursuant to Article 2 of the Criminal Procedure Code (CMK), the right to a defence and other guarantees come into effect.<\/span><\/p><p><span style=\"font-weight: 400;\">The basis of the criminal investigation\u201c<\/span><a href=\"https:\/\/blog.lexpera.com.tr\/kanunilik-ilkesi-baglaminda-belirlilik-ve-kiyas-yasagi\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">principle of legality<\/span><\/a><span style=\"font-weight: 400;\">\u201dcreates\". That is to say, if an act is not explicitly defined as a crime in law, nobody can be punished for that act. The charge levelled against the suspect must be clear, concrete and specific.<\/span><\/p><p><span style=\"font-weight: 400;\">Also, pursuant to Article 73 of the Turkish Penal Code (TCK), the prosecution of certain offences is subject to a complaint. If the right to complain is not exercised by the victim within six months, an investigation cannot be conducted. This period begins to run from the day the victim learns of the act and the offender.<\/span><\/p><h4><b>Handy Tip:<\/b><\/h4><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When an accusation is made against you, make sure to find out what crime is being alleged, what evidence is being used, and on the basis of which legal article the investigation is being conducted.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Check whether the offence is subject to a complaint. Therefore, Article 147 of the Code of Criminal Procedure regulates in detail all procedural safeguards that must be observed during the taking of statements.<\/span><\/p><p><span style=\"font-weight: 400;\">Before a statement is taken, these matters must be clearly explained to the person:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">What offence the statement was given for<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the right to choose a lawyer was available<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He has the right to remain silent<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">that anything you say may be used as evidence against you<\/span><\/li><\/ul><p><a href=\"https:\/\/azelhukuk.com\/en\/services\/criminal-law\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Criminal defence lawyer<\/span><\/a><span style=\"font-weight: 400;\"> Giving a statement without one often leads to a loss of rights. The period must be calculated correctly in the capacity of victim.<\/span><\/li><\/ul><\/li><\/ol><h3><b>Frequently Asked Questions (FAQ)<\/b><\/h3><h4>What is the maximum duration of police custody?\u00a0<\/h4><p><span style=\"font-weight: 400;\">For individual crimes it can be a maximum of 24 hours, and for collective crimes, up to four days by decision of the prosecutor.<\/span><\/p><h4><b>Can the detained person speak with a lawyer?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h4><p><span style=\"font-weight: 400;\">Yes. Giving a statement without the assistance of defence counsel leads to the impairment of the right to defence. The right to consult a lawyer is a fundamental safeguard.<\/span><\/p><h4><b>What happens if a statement is taken from me without my rights being informed to me?<\/b><\/h4><p><span style=\"font-weight: 400;\">This situation is contrary to procedure. If your rights are not communicated to you, the statement may be deemed invalid and you can take legal action.<\/span><\/p><h4><b>Can I claim compensation for unlawful detention?<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h4><p><span style=\"font-weight: 400;\">Yes.
