Tax debt calculation, Taxpayer appealing against the tax debt

Taxes are financial obligations collected from citizens within the framework of legal regulations in order to finance public services of the state. Pursuant to Article 73 of the Constitution of the Republic of Turkey, everyone is obliged to pay taxes according to their financial capacity. For this reason, a tax debt is not only a financial but also a constitutional responsibility.

However, tax debts can occasionally be assessed incorrectly, become time-barred, or collection proceedings may be initiated again for debts that have already been paid. In such cases, taxpayers have the right to object and file a lawsuit. We have detailed the tax debt objection process and the points to consider according to the current legislation for 2025.

What is a tax debt?

Tax debt arises as a result of the tax that the taxpayer is obliged to pay accruing and becoming definitive. For a tax to come into existence, all of the following processes must be completed:

  • Occurrence of the taxable event (earning income, delivery of goods, etc.)
  • Submission of the tax return
  • Assessment of tax (calculation by the tax authority)
  • Service of the notification

If the debt is not settled within the payment period, late payment interest and penalties will apply.

Example: A self-employed taxpayer is obliged to declare their 2024 income tax in March 2025. When the payment period is exceeded, the tax debt becomes final and late-payment interest begins to accrue.
